Copyright regulations governing Download and Usage of images from BelgaPicture
1. General conditions
1.1. All imagery on this site is protected by the relevant national and international copyright laws and conventions.
1.2. Belga declares having obtained the necessary copyright authorisations for the images displayed on BelgaPicture. In case the use of any image is subject to any restriction, this will be clearly indicated in the caption.
1.3. Usage rights on images are only accorded upon registration. Registration details are set out in the registration section of our website.
1.4. Each published BelgaPicture image will carry the mention '© Belga' followed by the name of the photographer. When an image originates from a source represented by Belga, the credit line of the published image reads 'Belga/name of the source'.
1.5. Prices exclude VAT. The prices are based on the specific use, including but not limited to factors as print run, image size, placement, insertions, duration of use and geographical distribution. We reserve the right to change prices at any time and without prior notice. For usage in printed and audiovisual media (see clause 3), a price list of specific types of usage of BelgaPicture images is available at our sales desk.
1.6. Any disputes between Belga and the user resulting from the usage of images of BelgaPicture is governed by Belgian law.
2. Limitations in scope
2.1. Usage rights are limited to the Belgian territory. Any person wishing to extend usage of these pictures beyond the Belgian territory has to obtain the prior written consent of Belga.
2.2. Usage rights are limited to use for illustration of news stories. Any person wishing to extend usage of these pictures for other purposes, has to obtain prior written consent of Belga. This includes the obligation not to use the images for advertising purposes unless prior written consent has been obtained from Belga.
2.3. Images of people need to be treated with the necessary sensitivity. The publication of such images may require their consent.
2.4. Images must be published in strict conformity with journalistic ethics. This includes the obligation not to give them any other meaning or description than the one communicated by the author.
3. Rights for usage of images in Printed and Audiovisual Media
3.1. The user can only publish BelgaPicture images in high resolution. Low-resolution pictures can only be used for layout purposes.
3.2. Following each publication of a BelgaPicture image, the user will send Belga a copy of the relevant publication within one week of its publication.
3.3. The aforementioned rights are granted for a single usage only. No re-usage, transfer of rights or re-sale of publication rights is allowed without prior specific and written authorisation of Belga.
4. Rights for usage of images on websites
4.1. The user can only display BelgaPicture images on websites in low resolution, corresponding to a maximum of 256 pixels per line.
4.2. Unless otherwise agreed, usage of BelgaPicture images on websites is authorised for 90 days following their respective download dates. After this period, the BelgaPicture images may not be stored in any form.
4.3. No re-usage, transfer of rights or re-sale of publication rights is allowed without prior specific and written authorisation of Belga.
5. Liability
5.1. The user accepts all liability arising from usage of the BelgaPicture images. This includes all liability arising from the texts, the captions as well as the context in which the aforementioned images are put to use. This also includes all liability for any violation of a person's personality or privacy right, as referred to in clause 2.4.
5.2. It is the user's responsibility to ensure that all necessary authorisations concerning the persons and works shown or represented are obtained.
